Cape Town High Court soon to Declare Directive 9 illegal
According to speculation, the High Court in Cape Town has recently declared Directive 9 of 2014 illegal. This means that any foreigner who applied for a visa extension or change of status and has not received an approved application whilst their current permit has expired, would no longer be declared an “undesirable person” when leaving the country.
According to sources, this information may only be confirmed once the High Court releases the court order. Once it has been processed, the Department of Home Affairs would have to then translate this into a directive.
