How would the new regulations affect me
I am currently using a visit visa in South Africa; can I apply for a temporary residence visa?
Under the “old legislation”, it was possible to apply for a temporary residence permit whilst using a visit visa but the “new legislation” now prohibits any foreigner applying for a temporary residence permit using a visitor’s visa.
If you currently using a visitor’s visa in South Africa and had the intention to apply for a longer term permit, your best option for now would be to leave South Africa and apply in your country of residence.
If your visa has expired, then you best need to seek legal advice about exiting South Africa as immigration officials were advised to ban any foreigners for overstaying by making them an undesirable person for 1 year, 2 years or 5 years.
When do I renew my existing permit?
The Department of Home Affairs has now made it official that all renewals should be submitted 60 days before expiry and no longer 30 days before expiry. If you currently using a Quota permit or Exceptional skills permit, you would not be able to renew your permit, contact us for more information.
The Department of Home Affairs has contracted VFS to receive all applications but for now the Department of Home Affairs is still accepting applications until the official handover is done.
